Electronic Discovery
Electronic Discovery is no longer accomplished simply by submitting stock discovery requests and canned answers, but must be as custom-fitted to your case as your complaint. Indeed, state and federal courts across the United States are placing a much higher burden on a requesting party, scrutinizing closely all electronic discovery requests. Using creative techniques, while strictly adhering to legal standards and forensically sound methodologies, our experts have consulted in a wide variety of situations, from complex litigations involving hidden financial fraud to basic analysis of computer and network systems. We pride ourselves in helping clients find “hidden” information that many times turn out to be the "smoking guns" that help win a case.
Electronic Discovery Requests
Electronic discovery requests must take into consideration the vast world of digital evidence, not only email and documents, but databases, instant message conversations, voice mail systems, log files, system files, swap files, hidden files, deleted or lost data, and more. This type of information is retrievable and usable if requested correctly and collected in a forensically sound manner. Further, by indexing and imaging that digital evidence we will make it easier for you to organize the body of evidence and integrate it into your litigation planning system.
In House Legal Staff
BIA’s experienced in-house legal staff, with years of real-world litigation and electronic discovery experience in complex class actions and corporate and securities litigations, is an essential part of our complete Electronic Discovery solution. BIA starts with a review of the relevant papers and discussions with the attorneys to understand the case from the inside out so that, when electronic discovery requests are made, the results are fruitful, relevant, and able to withstand judicial scrutiny. More importantly, without an understanding of both the claims and the technology at issue, an electronic discovery process will likely miss the important information that just may win the case.
We Are With You
BIA is there through the entire process: Drafting document requests and deposition notices (such as 30(b)(6) notices), assistance in preparation for, and if necessary, attendance at depositions, assistance with related motion practice, collection of the electronic data, and analysis of the results. From soup to nuts, BIA will be by your side through the entire process to provide you with as much or as little assistance as you feel necessary and appropriate.
Emergency Response Team (ERT)
BIA’s Emergency Response Team (ERT) can usually be onsite within 12 hours anywhere in the domestic United States, and within 24-48 hours worldwide, for rapid response, assessment and collection of digital evidence in both hostile and controlled environments. The ERT is comprised of highly skilled professionals trained and experienced in complex computing environments, criminal and civil forensics investigations, and the law.
Confidentiality and Professionalism
Confidentiality and Professionalism are the keys to our success. All analysis and consulting work is performed at the highest level of forensic scrutiny. We follow known forensic procedures and use only open and verifiable programming techniques. Our methodologies are transparent - we encourage the Court and opposing sides to dissect our work because we stand behind its admissibility one hundred percent. Because of this philosophy, we use NO PROPRIETARY or secret methods or programs when doing our analysis; instead, we use our programming skills to build tools and software specifically for the task at hand.
Research and Development
Research and Development are an integral part of BIA. The BIA team continuously updates and tunes its processes to keep up with the changing business and technology environments. BIA attorneys keep current on case law and BIA technologists and forensic examiners stay ahead of industry trends. The BIA team has worked on leading data recovery tools, system utilities and major IT installations. This insider knowledge of real world environments, continuous research and exceptional, experienced staff allows BIA to deliver services that are unmatched in the field.
Experience
BIA has a wide range of experience in both the public and private sector, ranging from Fortune 500 companies to governmental agencies, from large international law firms to solo practitioners. Given the confidential nature of our services, we do not publish a list of our clients. References are available upon request.
Teaching our customers and competitors is another source of pride for BIA. We offer a wide variety of courses on topics ranging from Digital Forensics and Electronic Discovery to Gramm-Leach-Bliley Act and Sarbanes Oxley Act Compliance. Indeed, we even teach our peers and competitors. Not only does training help keep our staff on the cutting edge of technology and the law, but it also helps insure that our clients are educated, and allows us to help define and shape our profession and assist in establishing accepted practices and procedures.
BIA’s foundations are built upon many years of combined experience in the technology, consulting and legal fields. BIA is headquartered in the Financial District in downtown Manhattan with offices in Seattle and San Francisco and global response units in Europe, Asia and the Middle East.
