FTC Second Requests and FCPA
investigations are on the rise with the increased regulatory
activity in the U.S. and abroad. Corporations and their counsel
face new challenges in collecting, analyzing and reviewing
multi-language documents with these cases. Deadlines are tight and
document volumes can run to the millions, to be collected from
different parts of the globe.
In this session, our seasoned
attorneys and technology experts will discuss the challenges
arising from these kinds of government and internal investigations.
We will address recent trends and the difficulties posed when
collecting, identifying, searching and analyzing electronic data
effectively. Our panelists will discuss the risks related to
non-compliance and how to overcome the many obstacles during an
investigation, including the effective management of multi-language
search, analysis and review and delivering results under stringent
timelines.
This session will cover:
- Working protocols to handle stringent timelines and fast-paced
review in the face of a government investigation/examinations
- Tips for effective case management from collection to
production
- Best practices for search, workflow and review of native
language or translated multi-language documents
- Guidelines for protecting privilege in Second Request
productions
- The pitfalls of rapid-fire collections in Asia and abroad and
the issues around foreign privacy laws
